Terms of Service

Last updated: 1 October 2026

1. Agreement to these terms

These Terms of Service (“Terms”) are a legally binding agreement between you (“you” or “Customer”) and NiceHuman (“we,” “us,” or “our”) governing your use of Cairn, our pet aftercare software available at cairn.pet and app.cairn.pet, including the pet owner and clinic portals and any related services (together, the “Service”).

By creating an account or using the Service you agree to these Terms. If you are using the Service on behalf of a business, you confirm that you have authority to bind that business, and “you” refers to it. If you do not agree, do not use the Service.

We may update these Terms. If we make material changes we will email account holders and post a notice in the application at least 30 days before they take effect. Continuing to use the Service after that date means you accept the updated Terms.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. The Service is intended for pet aftercare businesses, their partner clinics, and the pet owners they serve.

3. Accounts and access

3.1 Your account

You agree to provide accurate and complete information when you register and to keep it current. You are responsible for everything done under your account and for keeping your users’ credentials confidential. Tell us promptly at nathan@cairn.pet if you suspect unauthorized use.

3.2 Users, locations, and partner clinics

Account administrators may add staff users, locations, and partner clinics and control what each can see and do. You are responsible for the people you grant access to and for removing access when it is no longer appropriate.

3.3 Owner and clinic portals

Pet owners and clinic staff who use a portal you provide do so under these Terms and your own agreements with them. You are responsible for having the right to enter their information into the Service.

4. The Service

4.1 License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your internal business purposes during your subscription.

4.2 Acceptable use

You agree not to:

4.3 Changes to the Service

We improve the Service continuously and may add, change, or remove features. We will not materially reduce the core functionality you pay for during a subscription period without notice.

5. Fees and billing

5.1 Pricing

The Service is billed monthly at the prices published at cairn.pet/#pricing, in US dollars: a base monthly fee that includes a set number of cases, plus per-case fees for cases beyond that number at the volume tier shown in the pricing table. There are no tiers of features and no annual commitment.

5.2 Price lock

The base monthly fee and per-case rates in effect when you open your account will not increase for three years from that date, so long as your account remains open. After that, and for any new products or services, we may change prices with at least 30 days’ notice.

5.3 Payment

Fees are charged at the start of each monthly billing period, with per-case fees for the previous period added to the next invoice. Payments are processed by Paddle, which acts as merchant of record, and by paying you agree to Paddle’s terms. You confirm you are authorized to use the payment method you provide. If a payment fails we will notify you, and may suspend the account if it remains unpaid for 14 days.

5.4 Cancellation and refunds

You may cancel at any time from your account settings or by emailing us. Cancellation takes effect at the end of the current monthly period, and you keep access until then. Because there is no annual commitment, we do not refund the current month, except where required by law.

5.5 Taxes

Prices do not include sales or other taxes. You are responsible for any taxes that apply to your use of the Service, other than taxes on our income.

6. Customer data

6.1 You own your data

You retain all rights to the information you and your users enter into the Service, including customer lists, cases, invoices, messages, and transactions (“Customer Data”). We claim no ownership of it.

6.2 Our license to it

You grant us the right to host, copy, transmit, and display Customer Data only as needed to provide and support the Service, to keep it secure, and as you direct. Our handling of personal information is described in the Privacy Policy, which forms part of these Terms.

6.3 Your responsibilities

You confirm that you have the right to enter Customer Data into the Service and that doing so does not violate any law or anyone’s rights. You are responsible for the accuracy of Customer Data and for any consents pet owners and clinics must give.

6.4 Export and deletion

You can export your Customer Data in a machine-readable format at any time from within the application. After your account closes we keep Customer Data for 30 days so you can export it, then delete it, except case records and chain-of-custody logs, which we retain for 7 years from case closure as described in the Privacy Policy and will provide to you on request, and anything else the law requires us to keep.

7. Intellectual property

The Service, including its software, design, and the Cairn name and logo, belongs to NiceHuman and its licensors and is protected by intellectual property law. Apart from the rights expressly granted in these Terms, we reserve all rights. If you send us feedback or suggestions, we may use them without obligation to you.

8. Third-party services

The Service relies on third-party providers for hosting, email delivery, and payments, and may link to sites we do not control. We are not responsible for third-party services, and your use of them is subject to their own terms.

Text messages are sent through an SMS provider account that you connect to the Service. Your relationship with that provider, including its fees, deliverability, and acceptable-use rules, is between you and it, and you are responsible for keeping the connection in good standing and for complying with telephone marketing law in the messages you send.

9. Availability and support

We aim to keep the Service available at all times, but do not guarantee uninterrupted access. We will give notice of planned maintenance where practical. Support is available by email at nathan@cairn.pet, and onboarding is included at no charge.

10. Term and termination

These Terms apply from the day you open an account until it is closed. You may close your account at any time (see section 5.4). We may suspend or close your account with notice if you materially breach these Terms and do not cure the breach within 14 days of being told, or immediately if the breach involves illegal activity, a threat to the security of the Service, or non-payment beyond the period in section 5.3. On termination your right to use the Service ends, and sections 6, 7, 11, 12, 13, and 14 survive.

11. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected. Some jurisdictions do not allow these exclusions, in which case they apply to the fullest extent permitted.

12. Limitation of liability

To the fullest extent permitted by law, NiceHuman and its officers, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to these Terms or the Service. Our total liability for all claims will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or US $100. Some jurisdictions do not allow these limits, in which case our liability is limited to the fullest extent permitted.

13. Indemnification

You agree to defend, indemnify, and hold harmless NiceHuman and its officers, employees, and agents from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your Customer Data, your breach of these Terms, or your violation of any law or the rights of any third party.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Before starting any formal proceeding, you agree to contact us at nathan@cairn.pet and give us 30 days to resolve the dispute informally. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction. To the extent permitted by law, disputes will be resolved on an individual basis and not as part of a class or representative action.
